Terms of Service
These terms govern your use of the Open Prompter iOS app and the openprompter.app website (together, the “Service”). The Service is provided by Leland Dutcher (“we”, “us”, “our”), an independent developer based in the United States.
If you don't agree with these terms, don't use the Service.
1. The app is free and open source
Open Prompter is distributed free of charge on the Apple App Store. Its source code is released under the MIT License and available at github.com/lelanddutcher/open-prompter.
You may download, use, copy, modify, distribute, and build on Open Prompter under the terms of the MIT License, a copy of which is included in the source repository.
2. What the app does
Open Prompter reads markdown files from a folder you choose and displays them as teleprompter scripts. It has no accounts, no subscriptions, no in-app purchases, no network functionality of its own, and no server component.
You are responsible for:
- Having a valid Apple ID if you install via the App Store
- The content of the markdown files you point the app at
- Complying with any licenses or agreements attached to your files
- Backing up anything you value
3. Your files
We never see, store, or transmit your files. See the Privacy Policy for details.
Using the built-in editor, you can modify files in your folder. The app writes back through the system file coordinator on your device. We don't warrant that a write succeeds if, for example, the file is read-only, the disk is full, iCloud is offline, or another app has the file locked. Keep your own backups.
4. No warranties
Open Prompter is provided “as is” and “as available”, without warranty of any kind, express or implied, including without limitation the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, bug-free, or secure.
You use the Service at your own risk.
5. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Leland Dutcher be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, revenue, data, or goodwill — arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim relating to the Service is limited to the amount you paid for the Service in the twelve months preceding the claim, which for a free app is US $0.
Some jurisdictions don't allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you.
6. Third-party services
The Service is distributed through the Apple App Store, whose terms you also agree to when you download it. If you use Open Prompter with files stored in Apple iCloud, Obsidian, Dropbox, Google Drive, or any other provider's folder, those services have their own terms and privacy practices that apply independently.
Open Prompter bundles the following open-source fonts, distributed under the SIL Open Font License (OFL) 1.1:
- Atkinson Hyperlegible, © 2020 Braille Institute of America
- Lexend, © 2018 Thomas Jockin
Full OFL license text is included in the app bundle.
7. Open source contributions
If you open a pull request against github.com/lelanddutcher/open-prompter, you agree that your contribution may be incorporated into the project and distributed under the MIT License that governs the project.
8. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws provisions. Any dispute arising out of these terms or your use of the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there. If you are located in a jurisdiction where consumer-protection law mandates a different venue or choice-of-law, that mandate controls to the extent required by applicable law.
9. Changes to these terms
We may update these terms from time to time. Material changes will be noted on the openprompter.app website and in the App Store release notes. Your continued use of the Service after a change constitutes acceptance of the updated terms.
